What the Town of Hempstead requires
- The Town requires a Right-of-Way Permit from its Department of Highways before anyone builds, relocates or repairs a driveway or curb cut that abuts a highway, and every apron and curb cut must be concrete.
- The Town's application fee for a residential curb cut permit is $55 for each single-car-width driveway and $75 for each double-car-width driveway.
- At the curb line, the Town caps a dwelling's curb cut at 10 feet for one-car access and 18 feet for two-car access.
- Each driveway or curb cut permit application must be signed and acknowledged by the applicant and include a fully dimensioned site plan of the existing and proposed driveways, curbs and sidewalks on the property and on each side of it.
- On corner property, the Town requires at least 25 feet between a curb cut and the property line of the adjoining street, extended to the curb line, and every curb cut must keep 24 inches from side property lines at the curb line.
- The Town's Right of Way Permit form allows only concrete for aprons and sidewalks. A circular apron driveway needs at least 18 feet between its two aprons and at least 50 feet of property frontage.
- Homeowners in the Town must maintain the strip from the curb to the property line on every side of a lot that faces a road, and any work there by a homeowner or utility needs a Highway Department permit.
- Before sidewalk work begins, the owner or the owner's contractor must get a Sidewalk Permit from the Town's Highway Department.
- When the Town gives notice of needed sidewalk repairs, property owners have 30 days from the notice date to finish them privately, and sidewalk upkeep falls under Chapter 181 of the Town Code.
- The Highway Department's fee schedule, with fees as of 12/31/2018, lists $35.00 for a residential sidewalk repair or replacement permit.
